ObamaCare is mandatory government Healthcare and a bridge to Obama’s Government-run Healthcare Monopoly. If government healthcare is Not mandatory then why did Obama and his congress add a tax fine to punish those who exercise their constitutional right to refuse ObamaCare?

Per H.R.3200 as currently written, ObamaCare is Universal Government Control of our healthcare decisions as noted by:
(1) Americans without acceptable Obamacare coverage will be punished by an additional 2.5% tax per H.R.3200 section 401 (pgs 167-168) TAX ON INDIVIDUALS WITHOUT ACCEPTABLE HEALTH CARE COVERAGE:

”(a) TAX IMPOSED.—In the case of any individual who does not meet the requirements of subsection (d) at any time during the taxable year, there is hereby imposed a tax equal to 2.5 percent of the excess of—
(1) the taxpayer’s modified adjusted gross income for the taxable year, over
(2) the amount of gross income specified in section 6012(a)(1) with respect to the taxpayer. . . .”

Translation: Anyone caught without acceptable coverage will pay a special tax and the IRS will enforce the federal government control which prevents your liberty to select the healthcare coverage you believe you need.
Section 122 (pgs 26-30) “ESSENTIAL BENEFITS PACKAGE DEFINED” defines “acceptable” coverage which leaves you no healthcare coverage choices and makes carrying insurance for catastrophic events (such as Health Savings Accounts) illegal.

This proposed section was confirmed on Sep 25, 2009 when Tom Barthold, Joint Committee on Taxation Chief of Staff, sent Republican Senator John Ensign (Nevada) a handwritten note confirming a tax penalty for not buying health insurance. Evading the tax penalty can cost you up to 25,000 and a year in jail. Source

(2) H.R.3200 Sec.102 ‘Protecting The Choice To Keep Current Coverage,’ basically states we can keep our private insurance only if we obey Obama and never change our private insurance plan and we cannot buy another private individual insurance plan when we change jobs. In effect, ObamaCare will eventually kill free market competition which has lowered costs.

If anyone believes this is disinformation then they have NOT reviewed H.R. 3200.

(3) Every American will be issued a National ID Healthcard which will track their eligibility for a specific health service. Note that the phrase, ‘which may include utilization of a machine-readable health plan beneficiary identification card’ is one way the government will track your health service eligibility. What happens in a emergency when you need life saving surgery and your government healthcard determines you are Not eligible for life saving health services?

So for example, you had a preexisting condition, the private insurance companies could not deny you health insurance… and that is what this bill (Obamacare H.R.3200) is doing.” -Sen. Al Franken (D-Minn.) at the Minnesota State Fair, Sep 2, 2009

A Miss Moneypenny Photoshop Production (1)

In factual reality (not Al in Carp of Crap Wonderland reality), “H.R.3200 Section 111. PROHIBITING PRE-EXISTING CONDITION EXCLUSIONS” can impose a preexisting condition exclusion as noted in section 2791(d)(9) of the Public Health Service Act.

Since H.R. 3200 frequently refers to other laws and regulations, each section needs to be carefully reviewed in order to determine how much control Obama will have over Americans and our healthcare decisions.

For Reference, here are the key regulations with bold highlights:

Section 111. PROHIBITING PRE-EXISTING CONDITION EXCLUSIONS.

A qualified health benefits plan may not impose any pre-existing condition exclusion (as defined in section 2701(b)(1)(A) of the Public Health Service Act) or otherwise impose any limit or condition on the coverage under the plan with respect to an individual or dependent based on any health status-related factors (as defined in section 2702(a)(1) of the Public Health Service Act) in relation to the individual or dependent.

In order to understand what Obama and Al Franken means, we need to read the included regulations.

PHSA section 2701(b)(1)(A) (ref. pg. 1175):

IN GENERAL.-The term “preexisting condition exclusion” means, with respect to coverage, a limitation or exclusion of benefits relating to a condition based on the fact that the condition was present before the date of enrollment for such coverage, whether or not any medical advice, diagnosis, care, or treatment was recommended or received before such date.

PHSA Section 2791(d)(9) (ref. pg. 1212): The term “health status-related factor” means any of the factors described in section 2702(a)(1).

PHSA Section 2702 (a)(1) (ref. pg. 1181) states:

(a) INELIGIBILITY TO ENROLL.-

(1) IN GENERAL.-Subject to paragraph (2), …a group health plan, and a health insurance issuer offering group health insurance coverage in connection with a group health plan, may not establish rules for eligibility (including continued eligibility) of any individual to enroll under the terms of the plan based on any of the following health status-related factors in relation to the individual or a dependent of the individual:

(A) Health status.
(B) Medical condition (including both physical and mental illnesses).
(C) Claims experience.
(D) Receipt of health care.
(E) Medical history.
(F) Genetic information.
(G) Evidence of insurability (including conditions arising out of acts of domestic violence).
(H) Disability.

(2) NO APPLICATION TO BENEFITS OR EXCLUSIONS.-To the extent consistent with section 701 paragraph (1) shall not be construed-

(A) to require a group health plan, or group health insurance coverage, to provide particular benefits other than those provided under the terms of such plan or coverage, or

(B) to prevent such a plan or coverage from establishing limitations or restrictions on the amount, level, extent, or nature of the benefits or overage for similarly situated individuals enrolled in the plan or coverage.

Note that SEC. 2701. INCREASED [300gg] PORTABILITY THROUGH LIMITATION ON PREEXISTING CONDITION EXCLUSIONS. (ref. pg. 1175) allows the federal government to exclude a preexisting condition:

(a) Limitation on Preexisting Condition Exclusion Period; Crediting for Periods of Previous Coverage.–Subject to subsection (d), a group health plan, and a health insurance issuer offering group health insurance coverage, may, with respect to a participant or beneficiary, impose a preexisting condition exclusion only if– (1) such exclusion relates to a condition (whether physical or mental), regardless of the cause of the condition, for which medical advice, diagnosis, care, or treatment was recommended or received within the 6-month period ending on the enrollment date; (2) such exclusion extends for a period of not more than 12 months (or 18 months in the case of a late enrollee) after the enrollment date; and (3) the period of any such preexisting condition exclusion is reduced by the aggregate of the periods of creditable coverage (if any, as defined in subsection (c)(1)) applicable to the participant or beneficiary as of the enrollment date.

In summary, the federal government through federal health ‘advisory’ committees are given the right to determine what kind of healthcare will be provided and what kind of health conditions will be excluded in a similar manner that private insurance companies use currently to determine the risks they will take when insuring your health.

Here is the video of Sen. Al Franken using smoke and mirrors from Switzerland to convince his constituents that ObamaCare snake oil is better than the snake oil of the “evil” private insurance companies…

Hopefully, Minnesotans and Senator Hollydale are proud of Rep. Michelle Bachmann who isn’t afraid to stand up for our Constitution as a true Representative of American Liberty…

Jackson doesn’t know that CO₂ is a necessary component in the balance of the carbon cycle between animals and plants.

Interesting to note how the Liberal media failed to mention that Rachel Brown is a Democratic Lyndon Larouche supporter when reporting Frank’s angry tirade, “On what planet do you spend most of your time?”, at the Dartmouth Town Hall.

Unfortunately, the HMO Act of 1973 introduced by Senator Ted Kennedy and signed into Public Law 93-222 lowered the quality of healthcare and increased the cost of healthcare insurance. Since HMOs determine what insurance benefits they will pay for, the quality of medical care plummeted and my insurance premium costs increased 56 percent.

Which Mess is Obama talking about?

Did Obama conveniently forget the Mess of the Fannie Mae Mortgage Crisis which began with the Billary Clinton Administration?

Did Obama conveniently forget the Mess created by the Democratic Congress when the Democrats took over the Congress in 2007?

Did Obama conveniently forget the $12 Trillion Deficit Mess created by the Democratic Congress.

Did Obama conveniently forget the Stimulus Mess he helped to create? The Stimulus Mess has stimulated his special interests, grew government, and done too little to end the recession while the unemployment rate continued to rise.

Unrestricted government (euphemism for Taxpayer) subsidized healthcare increased the cost of healthcare and taxes for everyone. For example, the government estimated the hospital insurance portion of Medicare would cost $5.5 billion yet, the actual cost was more than four times that amount — $25.6 billion and this was for 1980 only. Twenty-three new taxes were enacted in the first 30 years of Medicare to cover the cost of government growth(1).

Did Obama conveniently forget the Mess he wants to create with his Universal Healthcare Bill, H.R.3200 aka ObamCare?
